ORANGE COUNTY KARATE CENTER LIABILITY WAIVER
I, (The “Participant”), hereby agree that In consideration for my participation in activities associated with the “Orange County Karate Center LLC” (“Service Provider”), and if such Participant is a minor, the Participant's parent or legal guardian, and their executors, personal representatives, respective heirs, administrators, and next of kin (collectively with Participant, "Releasors"), hereby agree and acknowledge the following:
1. That by signing this Liability waiver, I consent to waive certain legal rights, including the right to sue the "Service Provider," and, if applicable, its Owners, agents, representatives, and affiliates from any loss, injuries, or damages that may happen to me during my participation in any and all Martial Arts/Karate Classes associated with Service Provider hereinafter known as (the “Activities”).
2. I understand and am aware that my participation in the Activities involves tangible or intangible harms, which includes but not limited to physical injuries which may lead to muscle strains, muscle sprains, muscle spasms, raised blood pressure, illness, broken, fractured, or dislocated bones or death (the “Losses”), and I agree that stated losses may result not only from my actions but also from the other's actions. With the knowledge and understanding of said risks, I choose my own will and volition to continue participating in Activities.
3. I also acknowledge and am aware that there are various risks that I may not have determined, yet I waive my right to any and all claims that may result from these undetermined and unconsidered risks, and I choose, of my own will and decision, to participate in the Activities associated with Service Provider.
4. It is my liability to consult a physician prior to participating in activities, and I confirm that I am medically fit and have no medical conditions that would prohibit me from participating in any of the activities.
5. While participating in the Activities, if I face any injury, I hereby authorize the Service Provider to do any emergency medical treatment which Service Provider deemed necessary.
PHOTO/VIDEO RELEASE: I hereby grant permission to Service Provider while participating in activities to take and use my photograph/image, video in any and all publications thereof, including web site entries, without payment or any other consideration in perpetuity. I hereby authorize Service Provider to record, edit, alter, copy, exhibit, publish or distribute collectively, “Use” all photos/ images and videos. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my photo appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph/images and/or videos.
COVENANT NOT TO SUE: I will not initiate any lawsuit or other court action against the Service Provider, nor will I join any such proceeding, including any claim for monetary damages. I admit and agree that I am entering a covenant not to sue the Service Provider in any ability, including to hold the Service Provider liable for any injury, losses, or damage sustained by me or my property, even if it is because of the Service Provider's negligence or omission. I also relinquish the right of any of my insurers' to demand any such claim.
INDEMNIFICATION: I hereby agree to waive any and all legal claims against the Service Provider and indemnify the Service Provider and its affiliates, (if applicable) directors, officers, subsidiaries, employees, agents, successors, assigns, and sponsors and hold them harmless against any and all damages, losses, injury whether tangible or intangible, legal claims, and demands, including reasonable attorney's fees, which may arise from or relate to my participation in Activities or my conduct or actions.
APPLICABILITY: This liability Waiver will bind and be enforceable against me and all of my representatives. I agree that this liability Waiver should be imposed to the fullest extent of the law, and if any part thereof is held void or invalid, the remainder should continue in full legal force and effect.
GOVERNING LAW: This Liability Waiver shall be construed and interpreted in accordance with the laws of the state of California.
EXECUTION: I have read this liability waiver and agree that by signing this, I forfeit any right, claim, or ability to hold the Service Provider responsible for any losses related to the activities which may occur before, during, and after participating in the activities associated with Service Provider.
